4. The sale continues
Once the consumer chooses a product or service, the sale is completed. Specific agreements then apply, which may differ between in-store sales and online (distance) sales.
- Payment
The company must clearly indicate how and when the consumer can pay, which payment methods are accepted, and whether any additional costs apply. The price must be fair, not misleading, and stated in Aruban florin.
- Confirming the content of the purchase
The company must confirm orders and agreements in writing to the consumer, including all clear and correct information about the product or service. This obligation applies to distance sales and does not apply to in‑store purchases.
- Distance sales (online, by telephone, or by mail)
In sales without personal contact, such as via the internet or by telephone, the consumer has additional rights. You must provide clear information before and after the purchase and confirm the agreement in writing.
- General terms and conditions
General terms and conditions are standard rules that a company uses in multiple agreements. A company must ensure that its general terms and conditions are reasonable, clear, and made available to the consumer in advance. Unfair or misleading provisions are not allowed and may be declared invalid.
- Delivery and delivery services
A company must deliver the product within the agreed delivery period or, if no specific period is agreed, within a reasonable period. The company must clearly inform the consumer how and when the product will be delivered.
