Cartels, dominant market position, mergers and acquisitions, and competition oversight
- 1. Cartels
Companies or trade associations are not allowed to make agreements on prices, markets or customers. Such cartels undermine fair competition. Cartel behavior can be reported to AFTA. In certain cases, it is possible to submit a request for an exemption for a form of cooperation, for example where the cooperation leads to benefits for consumers that outweigh the restriction of competition.
- 2. Abuse of a dominant market position
A company is allowed to hold a dominant market position. However, it may not abuse that position. Learn to recognize the most common forms of abuse.
- 3. Concentration: Mergers, Acquisitions, and Joint Ventures
Do you intend to merge with another company or acquire a business? In certain cases, you are required to notify the AFTA in advance, depending on the combined turnover of the undertakings involved and their market share in Aruba.
- 4. Supervision of competition and market functioning
AFTA supervises compliance with the Competition Ordinance, investigates signals, and conducts market studies. It operates in accordance with a prioritization policy. AFTA focusses on cases with the greatest impact, risk, and social importance.
