If a company delivers a product that the consumer did not order, the consumer has no obligation to pay.
A company may not charge the consumer for an unsolicited product.
In this situation:
- the consumer may keep the product free of charge;
- if the consumer chooses to return the product, the company must pay the return costs;
- the consumer may also refuse to return the product and keep it without any obligation to pay.
A company may not create any payment obligation for a product that the consumer did not request.
