1. Is the sale a consumer sale?
A consumer sale is when a consumer buys a product from a company, in which the law gives extra protection to the consumer.
- Selling to consumers as a business: the rules on consumer sales apply
Does the company sell to private individuals for private use? In that case, consumer law applies and the consumer receives additional legal protection.
- Intermediary and consumer sales
Does the company sell a product on behalf of someone else? In that case, the rules on consumer sales may still apply if it is not clear to the consumer that the company acts only as an intermediary.
- Consumer rights
Consumer rights are legally protected. The company may never limit or exclude these rights, not even in its terms and conditions.
