Consumer rights are mandatory law: the company may not exclude or limit them, not even through the company’s general terms
and conditions.

 

What does this mean in practice?

1. Legal protection
In a consumer sale, the consumer receives legal protection when buying a product from a professional company. The company must respect these consumer rights at all times, regardless of its own terms, conditions, or contracts.

2. Agreements in a consumer sale must not conflict with the law
All agreements the company makes about price, delivery, payment, or warranty must comply with the law. The company’s general terms and conditions may not conflict with consumer law.

3. Aruban law always applies to consumers in Aruba
Does the company sell from abroad or declare foreign law applicable to the contract? Even in that case, a consumer who lives in Aruba remains protected under Aruban law. This protection always applies, including in cross‑border purchases.
