Decision dated 20 January 2025 regarding the complaint filed by Medlab against UOAZV and SZA.

The AFTA rejects the enforcement request submitted by Noord Medical Center N.V. (“Medlab”) against the Uitvoeringsorgaan Algemene Ziektekostenverzekering (“UOAZV”) and the Stichting Ziekenverpleging Aruba (“SZA”). When concluding agreements with laboratories in order to fulfill its obligation to provide benefits to AZV insured persons within the framework of the social healthcare system, UO AZV does not act as an undertaking within the meaning of the Competition Ordinance. Therefore, there is no infringement of the Competition Ordinance by UO AZV and SZA.

Decision on objection – Noord Medical Center N.V. and SZA

Decision of the Aruba Fair Trade Authority regarding the objection submitted by Noord Medical Center N.V. against the decision of 20 January 2025 (reference AFTA-RvB-001/25).

The Board of Directors of the Aruba Fair Trade Authority (hereinafter: AFTA) has taken a decision following the objection dated 10 February 2025, submitted by Mr. L.D. Gomez in his capacity as authorized representative of Noord Medical Center N.V. (hereinafter: MedLab), against AFTA’s decision of 20 January 2025. In this decision, AFTA declares MedLab’s objection unfounded and upholds the contested decision, supplemented by the reasoning set out in this decision.
