The Aruba Fair Trade Authority (AFTA) rejects the request for enforcement submitted by Noord Medical Center N.V. (“Medlab”) against the Uitvoeringsorgaan Algemene Ziektekostenverzekering (“UOAZV”) and the Stichting Ziekenverpleging Aruba (“SZA”).

When concluding agreements with laboratories in order to fulfil its statutory obligation to provide benefits to AZV-insured persons within the framework of the social healthcare system, UOAZV does not act as an undertaking within the meaning of the Competition Ordinance. Therefore, there is no infringement of the Competition Ordinance by UOAZV or SZA.
