Aruba Fair Trade Authority invites SETAR for a meeting.

The Aruba Fair Trade Authority (AFTA) has taken note of signals in the media regarding conduct by, among others, SETAR that may be in violation of the Competition Ordinance, which entered into force on January 1. AFTA has invited SETAR for a meeting.  AFTA is an independent administrative authority that supervises compliance with the Competition Ordinance. The Competition Ordinance, among other things, prohibits abuse by undertakings holding a dominant position. Undertakings with a dominant position may also include state-owned companies. When deciding whether to initiate an investigation, AFTA must take into account its limited capacity and the impact of potential violations on the residents of Aruba. As the Competition Ordinance is a new law, AFTA will, in the coming period, devote attention to informing businesses, including through business associations.
